SMS for Debt Collection and Payment Reminders (POPIA-Compliant)

7 min read

Of all the use cases for bulk SMS, payment and debt-related messaging is the one where compliance deserves the most care. It's also one of the most effective uses of the channel - reminders sent by text get read and acted on far more reliably than a letter or an unanswered phone call. This is general information, not legal advice; a business running debt collection at scale should get advice specific to its situation.

Two different laws apply

POPIA governs the personal information involved - the phone number, the amount owed, any account details referenced in the message. The National Credit Act separately governs debt collection communication specifically: what can be said, and importantly, when it can be sent. Both apply at once to a debt-related SMS; satisfying one doesn't satisfy the other.

Keep the message factual, not the content of the debt

A reminder should state the fact of what's owed and by when, without unnecessary detail that could embarrass the recipient if seen by someone else looking at their phone - "Your account balance of R1,850 is now overdue, please contact us" is appropriate; language designed to pressure or shame is both a compliance risk and, frankly, not more effective at getting paid.

Timing restrictions are not optional

As touched on in our send-time guide, debt-related communication has specific restricted hours under the National Credit Act, on top of the general good-practice hours that apply to any marketing message. Scheduling reminders inside standard business hours on weekdays is the safe default; sending at night, early morning, or on Sundays and public holidays is where this category of messaging most often crosses into a genuine complaint.

Why the platform's moderation matters here

SimpliSend's automated content check runs on every outgoing message, including payment reminders, and a high-severity flag - language that reads as harassment or a threat rather than a factual notice - blocks the send outright rather than letting it go out and dealing with the complaint afterward. For a business running collections at any volume, that's a real safeguard against a single badly worded template causing harm across an entire list before anyone notices.

A practical checklist

  • State the amount and due date factually - no shaming or threatening language
  • Send only within permitted hours and days for debt-related communication
  • Always include a clear way to contact the business to resolve or query the amount
  • Keep records of what was sent and when, in case a dispute arises
  • Get legal advice on your specific collection process - this article is general information, not a compliance sign-off
